  3. might have already rested their case. might have already rested their case. What do you think uh have they done it? What do you think uh have they done it? What do you think uh have they done it? >> Uh >> Uh >> Uh no way. Not in my opinion. Um I think no way. Not in my opinion. Um I think no way. Not in my opinion. Um I think they've fallen flat. they've fallen flat. they've fallen flat. Starting right at their opening Starting right at their opening Starting right at their opening statement, which was now a few couple of statement, which was now a few couple of statement, which was now a few couple of weeks ago, all the way through to now. weeks ago, all the way through to now. weeks ago, all the way through to now. They're basically trying to paint a They're basically trying to paint a They're basically trying to paint a picture that she was either exact picture that she was either exact picture that she was either exact Lindsay Clancy was either exaggerating Lindsay Clancy was either exaggerating Lindsay Clancy was either exaggerating or complete or feigning, right? Making or complete or feigning, right? Making or complete or feigning, right? Making up for mental illness and that she's up for mental illness and that she's up for mental illness and that she's actually a cold calculated killer, was actually a cold calculated killer, was actually a cold calculated killer, was planning to um murder her three planning to um murder her three planning to um murder her three children, and manipulated somehow the children, and manipulated somehow the children, and manipulated somehow the the mental health system and the the mental health system and the the mental health system and the providers to do so. It seems so providers to do so. It seems so providers to do so. It seems so far-fetched. Um and I don't think that far-fetched. Um and I don't think that far-fetched. Um and I don't think that they've come even close to getting there they've come even close to getting there they've come even close to getting there and I think along the way they've and I think along the way they've and I think along the way they've ruffled some feathers, certainly in the ruffled some feathers, certainly in the ruffled some feathers, certainly in the court of public opinion, um and me just court of public opinion, um and me just court of public opinion, um and me just as an attorney watching this trial. They as an attorney watching this trial. They as an attorney watching this trial. They are, in a sense, weaponizing and are, in a sense, weaponizing and are, in a sense, weaponizing and demonizing mental illness, demonizing mental illness, demonizing mental illness, um and they're parading up people to um and they're parading up people to um and they're parading up people to say, "Well, she never told them that she say, "Well, she never told them that she say, "Well, she never told them that she was hearing voices, so therefore she was hearing voices, so therefore she was hearing voices, so therefore she could not have been in psychosis." It's could not have been in psychosis." It's could not have been in psychosis." It's just such an overreach. It's not just such an overreach. It's not just such an overreach. It's not factually supported medically, factually supported medically, factually supported medically, scientifically, or anyway else.

  4. scientifically, or anyway else. scientifically, or anyway else. Um they're basically asking their Um they're basically asking their Um they're basically asking their witnesses to say, "Well, she wasn't witnesses to say, "Well, she wasn't witnesses to say, "Well, she wasn't showing signs of psychosis. She wasn't showing signs of psychosis. She wasn't showing signs of psychosis. She wasn't um um um had suicidal ideation or homicidal had suicidal ideation or homicidal had suicidal ideation or homicidal ideations, and she was just depressed." ideations, and she was just depressed." ideations, and she was just depressed." Uh and using witnesses that really it's Uh and using witnesses that really it's Uh and using witnesses that really it's become clear had not spent a lot of time become clear had not spent a lot of time become clear had not spent a lot of time with her. with her. with her. Her main psychiatrist that she met with Her main psychiatrist that she met with Her main psychiatrist that she met with over and over again, she had never met over and over again, she had never met over and over again, she had never met until she walked in to testify until she walked in to testify until she walked in to testify uh uh Friday. uh uh Friday. uh uh Friday. So, they had never met each other in So, they had never met each other in So, they had never met each other in person. I understand telehealth has person. I understand telehealth has person. I understand telehealth has really taken over a lot of the medical really taken over a lot of the medical really taken over a lot of the medical treatment, and it's more efficient, and treatment, and it's more efficient, and treatment, and it's more efficient, and there's pressure for doctors and there's pressure for doctors and there's pressure for doctors and providers to see more patients, but to providers to see more patients, but to providers to see more patients, but to never have seen somebody who is never have seen somebody who is never have seen somebody who is decompensating in the way that it's come decompensating in the way that it's come decompensating in the way that it's come out that Lindsay was just is so out that Lindsay was just is so out that Lindsay was just is so unacceptable. Um I just think that she unacceptable. Um I just think that she unacceptable. Um I just think that she was in the hands of either inexperienced was in the hands of either inexperienced was in the hands of either inexperienced or not qualified um providers who claim or not qualified um providers who claim or not qualified um providers who claim to be specialists, and it really came to be specialists, and it really came to be specialists, and it really came out that that they weren't at all. out that that they weren't at all. out that that they weren't at all. >> It it it I mean, it sounds like what >> It it it I mean, it sounds like what >> It it it I mean, it sounds like what you're saying what you are saying is you're saying what you are saying is you're saying what you are saying is that they really overextended themselves that they really overextended themselves that they really overextended themselves uh in what they've tried to prove here uh in what they've tried to prove here uh in what they've tried to prove here by by saying that, you know, not only by by saying that, you know, not only by by saying that, you know, not only uh is she um uh is she um uh is she um guilty uh and wasn't criminally insane guilty uh and wasn't criminally insane guilty uh and wasn't criminally insane uh for the purposes of this case, but uh for the purposes of this case, but uh for the purposes of this case, but that she was that she was that she was really not that sick. That she that her really not that sick. That she that her really not that sick. That she that her attempts at taking her own life, that attempts at taking her own life, that attempts at taking her own life, that her uh seeking medical care, that none her uh seeking medical care, that none her uh seeking medical care, that none of that was really of that was really of that was really um um um I don't know, real. I- I- Is Is that the I don't know, real. I- I- Is Is that the I don't know, real. I- I- Is Is that the question for jurors though? Is this a question for jurors though? Is this a question for jurors though? Is this a case about was Lindsay Clancey sick, or

  5. case about was Lindsay Clancey sick, or case about was Lindsay Clancey sick, or what is the real question here? what is the real question here? what is the real question here? >> It's funny cuz it feels as though the >> It's funny cuz it feels as though the >> It's funny cuz it feels as though the prosecution has actually pivoted partway prosecution has actually pivoted partway prosecution has actually pivoted partway through the trial. Uh I think coming out through the trial. Uh I think coming out through the trial. Uh I think coming out in their opening statement if it was in their opening statement if it was in their opening statement if it was clear that they presented their theory clear that they presented their theory clear that they presented their theory that uh it was not a real attempted that uh it was not a real attempted that uh it was not a real attempted suicide, that she was not actually suicide, that she was not actually suicide, that she was not actually mentally ill, that she was shopping mentally ill, that she was shopping mentally ill, that she was shopping around to different doctors and taking around to different doctors and taking around to different doctors and taking medications or not taking medications, medications or not taking medications, medications or not taking medications, and she was in control of the whole and she was in control of the whole and she was in control of the whole thing. And then part way through it at a thing. And then part way through it at a thing. And then part way through it at a public hearing, but um not necessarily public hearing, but um not necessarily public hearing, but um not necessarily during in front of the jury, during in front of the jury, during in front of the jury, um the prosecution said, "Well, we're um the prosecution said, "Well, we're um the prosecution said, "Well, we're not You know, the judge said, 'Well, not You know, the judge said, 'Well, not You know, the judge said, 'Well, you're going forward on a theory that you're going forward on a theory that you're going forward on a theory that she's faking her her suicide, and the she's faking her her suicide, and the she's faking her her suicide, and the defense wants to call a It was an defense wants to call a It was an defense wants to call a It was an argument over an expert witness to argument over an expert witness to argument over an expert witness to testify that the fracture that Jefferson testify that the fracture that Jefferson testify that the fracture that Jefferson fracture she had in her spine was from fracture she had in her spine was from fracture she had in her spine was from falling or jumping headfirst, which falling or jumping headfirst, which falling or jumping headfirst, which would not comport with the would not comport with the would not comport with the Commonwealth's theory that they've been Commonwealth's theory that they've been Commonwealth's theory that they've been basically presenting this whole time basically presenting this whole time basically presenting this whole time that she slid down the outside and that she slid down the outside and that she slid down the outside and jumped. jumped. jumped. And the prosecution completely And And the prosecution completely And And the prosecution completely And that's the what we perceived and what that's the what we perceived and what that's the what we perceived and what the judge perceived. But then the the judge perceived. But then the the judge perceived. But then the prosecution backed off and said, "Oh, prosecution backed off and said, "Oh, prosecution backed off and said, "Oh, no, we're not saying it was a fake no, we're not saying it was a fake no, we're not saying it was a fake suicide attempt.

  6. suicide attempt. suicide attempt. Uh we're going to disclose our entire Uh we're going to disclose our entire Uh we're going to disclose our entire theory and kind of started started theory and kind of started started theory and kind of started started side-stepping and said, "We're going to side-stepping and said, "We're going to side-stepping and said, "We're going to show, you know, our theory basically is show, you know, our theory basically is show, you know, our theory basically is that she was able to kill her children, that she was able to kill her children, that she was able to kill her children, but she was not successful in in killing but she was not successful in in killing but she was not successful in in killing herself and to draw conclusions from herself and to draw conclusions from herself and to draw conclusions from that." So, they may or may not be that." So, they may or may not be that." So, they may or may not be recognizing that they came out recognizing that they came out recognizing that they came out supercharged here and and really supercharged here and and really supercharged here and and really overreached, and it's really rubbing overreached, and it's really rubbing overreached, and it's really rubbing people the wrong way in the way that people the wrong way in the way that people the wrong way in the way that they're they're they're sort of handling mental illness very sort of handling mental illness very sort of handling mental illness very roughly. roughly. roughly. Um it's very clear in watching that she Um it's very clear in watching that she Um it's very clear in watching that she is fragile is fragile is fragile uh in that courtroom. She's, you know, uh in that courtroom. She's, you know, uh in that courtroom. She's, you know, obviously she's only half a body work. obviously she's only half a body work. obviously she's only half a body work. She's in a wheelchair, but she's is She's in a wheelchair, but she's is She's in a wheelchair, but she's is sobbing hysterically. They keep having sobbing hysterically. They keep having sobbing hysterically. They keep having to take breaks and stop the trial to take breaks and stop the trial to take breaks and stop the trial because of how fragile her emotional because of how fragile her emotional because of how fragile her emotional state is, and they're trying to paint state is, and they're trying to paint state is, and they're trying to paint her as a cold, calculated murderer. her as a cold, calculated murderer. her as a cold, calculated murderer. Uh something's not adding up here. Uh something's not adding up here. Uh something's not adding up here. >> Yeah. >> Yeah. >> Yeah. Can they turn it around, though, because Can they turn it around, though, because Can they turn it around, though, because the the question really for jurors is the the question really for jurors is the the question really for jurors is not so much was she sick? Um not so much was she sick? Um not so much was she sick? Um I I I agree with you. I think there's I I I agree with you. I think there's I I I agree with you. I think there's abundant evidence to show that she was abundant evidence to show that she was abundant evidence to show that she was sick. I think there's abundant evidence sick. I think there's abundant evidence sick. I think there's abundant evidence to show she was really unwell, even to to show she was really unwell, even to to show she was really unwell, even to the point of legitimately trying to take the point of legitimately trying to take the point of legitimately trying to take her own life. But the question for her own life. But the question for her own life. But the question for jurors is in spite of all of that, even jurors is in spite of all of that, even jurors is in spite of all of that, even being in the depths of mental illness, being in the depths of mental illness, being in the depths of mental illness, even being uh perhaps mistreated by her even being uh perhaps mistreated by her even being uh perhaps mistreated by her therapist or not treated adequately, therapist or not treated adequately, therapist or not treated adequately, over-prescribed medications, what have over-prescribed medications, what have over-prescribed medications, what have you, you, you, um that she could still appreciate that um that she could still appreciate that um that she could still appreciate that murdering her children was wrong. That's

  7. murdering her children was wrong. That's murdering her children was wrong. That's really what jurors are going to have to really what jurors are going to have to really what jurors are going to have to decide. Do you think that this is decide. Do you think that this is decide. Do you think that this is already um already um already um slipped through the prosecution's slipped through the prosecution's slipped through the prosecution's fingers or is there an opportunity with fingers or is there an opportunity with fingers or is there an opportunity with the few the few the few days, perhaps a couple weeks that we days, perhaps a couple weeks that we days, perhaps a couple weeks that we have left for them to turn it around? have left for them to turn it around? have left for them to turn it around? >> They're certainly going to try, >> They're certainly going to try, >> They're certainly going to try, um but their tactics so far have not um but their tactics so far have not um but their tactics so far have not come to anything really conclusory, and come to anything really conclusory, and come to anything really conclusory, and they're creating possible explanations, they're creating possible explanations, they're creating possible explanations, like a possible explanation that like a possible explanation that like a possible explanation that maybe she was hearing a voice, maybe maybe she was hearing a voice, maybe maybe she was hearing a voice, maybe not. Um but as the evidence is coming not. Um but as the evidence is coming not. Um but as the evidence is coming out, their opening statement is not out, their opening statement is not out, their opening statement is not aligned with the evidence that's coming aligned with the evidence that's coming aligned with the evidence that's coming in through their witnesses. in through their witnesses. in through their witnesses. And you got to think, you know, the And you got to think, you know, the And you got to think, you know, the question they didn't have to go that question they didn't have to go that question they didn't have to go that far, right? We talked a couple weeks far, right? We talked a couple weeks far, right? We talked a couple weeks ago. They didn't have to say she wasn't ago. They didn't have to say she wasn't ago. They didn't have to say she wasn't sick at all. She wasn't suffering at sick at all. She wasn't suffering at sick at all. She wasn't suffering at all. She wasn't mentally ill at all. all. She wasn't mentally ill at all. all. She wasn't mentally ill at all. They did give that impression in their They did give that impression in their They did give that impression in their opening statement. That's what they were opening statement. That's what they were opening statement. That's what they were going for. It seems they're now backing going for. It seems they're now backing going for. It seems they're now backing off of that off of that off of that and are likely to argue and wrap up in and are likely to argue and wrap up in and are likely to argue and wrap up in their closing, which we're not close to their closing, which we're not close to their closing, which we're not close to that yet, that she was depressed, but that yet, that she was depressed, but that yet, that she was depressed, but she wasn't in psychosis. She wasn't sick she wasn't in psychosis. She wasn't sick she wasn't in psychosis. She wasn't sick enough. Um but remember, they have to enough. Um but remember, they have to enough. Um but remember, they have to prove that element prove that element prove that element beyond a reasonable doubt. So, it's not beyond a reasonable doubt. So, it's not beyond a reasonable doubt. So, it's not just, you know, preponderance, it's not just, you know, preponderance, it's not just, you know, preponderance, it's not just proving murder and then saying, you just proving murder and then saying, you just proving murder and then saying, you know, know, know, they're the defense didn't prove this.

  8. they're the defense didn't prove this. they're the defense didn't prove this. No, it's not the defense's burden in No, it's not the defense's burden in No, it's not the defense's burden in Massachusetts. Um as, you know, you Massachusetts. Um as, you know, you Massachusetts. Um as, you know, you learn, um I practice primarily in only learn, um I practice primarily in only learn, um I practice primarily in only in Massachusetts. You learn that other in Massachusetts. You learn that other in Massachusetts. You learn that other states don't operate the same. Other states don't operate the same. Other states don't operate the same. Other states require that the defense, once states require that the defense, once states require that the defense, once they raise that as a theory, that they they raise that as a theory, that they they raise that as a theory, that they need to prove it beyond a reasonable need to prove it beyond a reasonable need to prove it beyond a reasonable doubt. doubt. doubt. I actually think they probably, with the I actually think they probably, with the I actually think they probably, with the lineup of experts that they could have a lineup of experts that they could have a lineup of experts that they could have a shot at that, but it's not that's not shot at that, but it's not that's not shot at that, but it's not that's not the standard here. That's not the the standard here. That's not the the standard here. That's not the burden. 100% on the prosecution to prove burden. 100% on the prosecution to prove burden. 100% on the prosecution to prove it was murder, and it's 100% on the it was murder, and it's 100% on the it was murder, and it's 100% on the prosecution to prove beyond a reasonable prosecution to prove beyond a reasonable prosecution to prove beyond a reasonable doubt that she was not so overcome with doubt that she was not so overcome with doubt that she was not so overcome with psychosis. The way they're doing that is psychosis. The way they're doing that is psychosis. The way they're doing that is to say that she was making it up and she to say that she was making it up and she to say that she was making it up and she was manipulating the system. was manipulating the system. was manipulating the system. Um, you know, accusing her of doctor Um, you know, accusing her of doctor Um, you know, accusing her of doctor shopping. I I think every doctor that shopping. I I think every doctor that shopping. I I think every doctor that came up, the defense got out, she was came up, the defense got out, she was came up, the defense got out, she was honest, she was desperate for help. She, honest, she was desperate for help. She, honest, she was desperate for help. She, um, um, um, you know, was in a lot of contact with you know, was in a lot of contact with you know, was in a lot of contact with these different providers every two, these different providers every two, these different providers every two, three, four days, and she was switching three, four days, and she was switching three, four days, and she was switching on and off medications. on and off medications. on and off medications. But it's medications that they were all But it's medications that they were all But it's medications that they were all prescribing her, and they were not prescribing her, and they were not prescribing her, and they were not coordinating with each other, and they coordinating with each other, and they coordinating with each other, and they did not review each other's records.

  9. did not review each other's records. did not review each other's records. It's very concerning. It's very concerning. It's very concerning. >> Yeah. >> Yeah. >> Yeah. How do you think this all ends? Uh, do How do you think this all ends? Uh, do How do you think this all ends? Uh, do you think that there is that this is you think that there is that this is you think that there is that this is heading towards, not an acquittal, but a heading towards, not an acquittal, but a heading towards, not an acquittal, but a not guilty by reason of insanity, or do not guilty by reason of insanity, or do not guilty by reason of insanity, or do you think some jurors might struggle? you think some jurors might struggle? you think some jurors might struggle? >> I think the prosecution is hoping that >> I think the prosecution is hoping that >> I think the prosecution is hoping that some of the jurors struggle with the some of the jurors struggle with the some of the jurors struggle with the emotional aspect of it and the emotional aspect of it and the emotional aspect of it and the immorality of it, and just the ultimate immorality of it, and just the ultimate immorality of it, and just the ultimate outcome, which is three children are outcome, which is three children are outcome, which is three children are dead because of her. dead because of her. dead because of her. Um, you know, undisputedly. Um, you know, undisputedly. Um, you know, undisputedly. Um, and some some witnesses to that, I think on the police body cam, to that, I think on the police body cam, to that, I think on the police body cam, the police were called. There is a the police were called. There is a the police were called. There is a history of the police getting called. history of the police getting called. history of the police getting called. Um, you know, two months prior, Um, you know, two months prior, Um, you know, two months prior, allegedly there was a video of her allegedly there was a video of her allegedly there was a video of her slapping him. Um, we just don't know slapping him. Um, we just don't know slapping him. Um, we just don't know enough. Was this a Stockholm syndrome enough. Was this a Stockholm syndrome enough. Was this a Stockholm syndrome type of situation? And finally, she type of situation? And finally, she type of situation? And finally, she wanted to break free and she this is how wanted to break free and she this is how wanted to break free and she this is how she did it. Or was she the abuser or was she did it. Or was she the abuser or was she did it. Or was she the abuser or was he? And you know, her initial claim that he? And you know, her initial claim that he? And you know, her initial claim that it was self-defense and what she came it was self-defense and what she came it was self-defense and what she came out a couple of years ago saying, "Oh, out a couple of years ago saying, "Oh, out a couple of years ago saying, "Oh, she threw a knife across the room." she threw a knife across the room." she threw a knife across the room." Medical examiners basically said that's Medical examiners basically said that's Medical examiners basically said that's inconsistent with the findings. So, that inconsistent with the findings. So, that inconsistent with the findings. So, that started, I think, to fall apart started, I think, to fall apart started, I think, to fall apart um, on the defense side. But, in terms um, on the defense side. But, in terms um, on the defense side. But, in terms of the prosecution, there was a lot of of the prosecution, there was a lot of of the prosecution, there was a lot of complications, too, with she had taken complications, too, with she had taken complications, too, with she had taken his laptop and then her parents his laptop and then her parents his laptop and then her parents [clears throat] had hacked into it.

  14. [clears throat] had hacked into it. [clears throat] had hacked into it. And that could have been great evidence. And that could have been great evidence. And that could have been great evidence. However, uh, the prosecution violated However, uh, the prosecution violated However, uh, the prosecution violated attorney-client privilege by going attorney-client privilege by going attorney-client privilege by going through all those messages that were on through all those messages that were on through all those messages that were on the computer because they were the computer because they were the computer because they were communicating with her lawyer and so was communicating with her lawyer and so was communicating with her lawyer and so was she. she. she. So, they were they were federal charges So, they were they were federal charges So, they were they were federal charges that were dismissed against her parents. that were dismissed against her parents. that were dismissed against her parents. And the prosecution was sort of left And the prosecution was sort of left And the prosecution was sort of left holding the bag on that because that is holding the bag on that because that is holding the bag on that because that is a very severe violation, um, a very severe violation, um, a very severe violation, um, attorney-client privilege. So, that attorney-client privilege. So, that attorney-client privilege. So, that could have certainly contributed to it. could have certainly contributed to it. could have certainly contributed to it. Um, and you know, there's a lot of time Um, and you know, there's a lot of time Um, and you know, there's a lot of time and expense and expense and expense in a in a trial, especially a murder in a in a trial, especially a murder in a in a trial, especially a murder trial. trial. trial. And there was something that caused them And there was something that caused them And there was something that caused them to offer a reduced charge um, that to offer a reduced charge um, that to offer a reduced charge um, that basically saved the time and expense of basically saved the time and expense of basically saved the time and expense of trial. And on the defense side, trial. And on the defense side, trial. And on the defense side, if you don't have to expose yourself to if you don't have to expose yourself to if you don't have to expose yourself to life in prison, then it's it's a very life in prison, then it's it's a very life in prison, then it's it's a very serious consideration that you she could serious consideration that you she could serious consideration that you she could get out next year. get out next year. get out next year. >> Yeah. I I I I I agree with you. I think >> Yeah. I I I I I agree with you. I think >> Yeah. I I I I I agree with you. I think it's a win for the defense. I mean, it's a win for the defense. I mean, it's a win for the defense. I mean, especially too, when you look at it that especially too, when you look at it that especially too, when you look at it that she's already served the lion share of she's already served the lion share of she's already served the lion share of the time that they're going to ask her the time that they're going to ask her the time that they're going to ask her to serve anyway. It's not like she's to serve anyway. It's not like she's to serve anyway. It's not like she's been out all this time and now she has been out all this time and now she has been out all this time and now she has to wrap her head around going back to to wrap her head around going back to to wrap her head around going back to prison for 6 years. She's just going to prison for 6 years. She's just going to prison for 6 years. She's just going to stay put for another, like you said, stay put for another, like you said, stay put for another, like you said, maybe 18 months or so and then she'll be maybe 18 months or so and then she'll be maybe 18 months or so and then she'll be out. Um, out. Um, out. Um, talking about what goes into the mindset talking about what goes into the mindset talking about what goes into the mindset of a prosecutor when they're trying to of a prosecutor when they're trying to of a prosecutor when they're trying to decide whether or not to offer something decide whether or not to offer something decide whether or not to offer something is also the victim's family. And here

  15. is also the victim's family. And here is also the victim's family. And here the victim's family, it sounds like they the victim's family, it sounds like they the victim's family, it sounds like they were in support of this plea deal. were in support of this plea deal. were in support of this plea deal. But there was a civil suit But there was a civil suit But there was a civil suit uh that was running concurrent to this uh that was running concurrent to this uh that was running concurrent to this whole thing that was also settled whole thing that was also settled whole thing that was also settled uh on the heels of this plea for an uh on the heels of this plea for an uh on the heels of this plea for an undisclosed amount. But I'm curious, how undisclosed amount. But I'm curious, how undisclosed amount. But I'm curious, how much of a role do you think that played much of a role do you think that played much of a role do you think that played in it? How much, in other words, I've in it? How much, in other words, I've in it? How much, in other words, I've been asked the question, do you think been asked the question, do you think been asked the question, do you think the family said, "Listen, they paid out, the family said, "Listen, they paid out, the family said, "Listen, they paid out, we're done with this. Please just settle we're done with this. Please just settle we're done with this. Please just settle this thing and be done with it." And this thing and be done with it." And this thing and be done with it." And that that would maybe instruct the that that would maybe instruct the that that would maybe instruct the prosecution to do so. >> It's very possible. Essentially, um, you >> It's very possible. Essentially, um, you know, it's hard to know, but certainly know, it's hard to know, but certainly know, it's hard to know, but certainly they're related. they're related. they're related. Maybe the family just wanted her to Maybe the family just wanted her to Maybe the family just wanted her to accept responsibility and accept responsibility and accept responsibility and accountability, and her taking the plea accountability, and her taking the plea accountability, and her taking the plea deal, even a manslaughter, which is a deal, even a manslaughter, which is a deal, even a manslaughter, which is a lower lower lower intent, right? It's not the premeditated intent, right? It's not the premeditated intent, right? It's not the premeditated um or intentional intent as you get up um or intentional intent as you get up um or intentional intent as you get up in the degrees of murder, in the degrees of murder, in the degrees of murder, but her taking accountability provides but her taking accountability provides but her taking accountability provides closure to the family. Probably they closure to the family. Probably they closure to the family. Probably they also got a financial settlement also got a financial settlement also got a financial settlement settlement out of it. So, they don't settlement out of it. So, they don't settlement out of it. So, they don't have to go through a painful trial.

  16. have to go through a painful trial. have to go through a painful trial. Uh they still get her to admit that this Uh they still get her to admit that this Uh they still get her to admit that this was her fault through the plea deal. was her fault through the plea deal. was her fault through the plea deal. And they get some sort of settlement. And they get some sort of settlement. And they get some sort of settlement. So, whatever it was, they were So, whatever it was, they were So, whatever it was, they were satisfied. satisfied. satisfied. Um you know, in the trials that I have, Um you know, in the trials that I have, Um you know, in the trials that I have, sometimes the DA offers sometimes the DA offers sometimes the DA offers something. Uh sometimes they offer an something. Uh sometimes they offer an something. Uh sometimes they offer an amended down charge or we call a binding amended down charge or we call a binding amended down charge or we call a binding plea deal. Sometimes they don't at all. plea deal. Sometimes they don't at all. plea deal. Sometimes they don't at all. Sometimes on a homicide case they go, Sometimes on a homicide case they go, Sometimes on a homicide case they go, "We have this on video. This is a first "We have this on video. This is a first "We have this on video. This is a first degree. We're not even offering you a degree. We're not even offering you a degree. We're not even offering you a second." And the only difference between second." And the only difference between second." And the only difference between this first and a second here in terms of this first and a second here in terms of this first and a second here in terms of prison time is life without the prison time is life without the prison time is life without the possibility of parole and life with the possibility of parole and life with the possibility of parole and life with the possibility of parole. So, it's not even possibility of parole. So, it's not even possibility of parole. So, it's not even that much of a win, but sometimes they that much of a win, but sometimes they that much of a win, but sometimes they won't even offer that. They're really won't even offer that. They're really won't even offer that. They're really hell-bent on cases. So, it makes me hell-bent on cases. So, it makes me hell-bent on cases. So, it makes me think that there were some potential think that there were some potential think that there were some potential issues with the case and maybe the issues with the case and maybe the issues with the case and maybe the family was pushing to resolve this short family was pushing to resolve this short family was pushing to resolve this short of trial. of trial. of trial. >> Yeah, I agree with you. How strong a case is this? strong a case is this? strong a case is this? >> So, when a whenever a client make, you >> So, when a whenever a client make, you >> So, when a whenever a client make, you know, a client makes a statement or they know, a client makes a statement or they know, a client makes a statement or they make a confession or they admit to make a confession or they admit to make a confession or they admit to something, it's so cringeworthy for the something, it's so cringeworthy for the something, it's so cringeworthy for the lawyer. lawyer. lawyer. >> Right. >> Right. >> Right. >> It's It's It's It's It's just It's I'm >> It's It's It's It's It's just It's I'm >> It's It's It's It's It's just It's I'm not laughing at it. It's just 30 years not laughing at it. It's just 30 years not laughing at it. It's just 30 years later. later. later. >> Yeah. >> Yeah. >> Yeah. >> He's talking There's no statute of >> He's talking There's no statute of >> He's talking There's no statute of limitations on murder. limitations on murder. limitations on murder. >> Right. >> Right. >> Right. >> So, he was not even, you know, he wasn't >> So, he was not even, you know, he wasn't >> So, he was not even, you know, he wasn't just talking about the shooting and just talking about the shooting and just talking about the shooting and talking about maybe being involved in talking about maybe being involved in talking about maybe being involved in the argument at MGM, and then, oh, we the argument at MGM, and then, oh, we the argument at MGM, and then, oh, we got shot, and who knows? Like, literally got shot, and who knows? Like, literally got shot, and who knows? Like, literally put himself in the car, literally said put himself in the car, literally said put himself in the car, literally said that he provided the gun.

  19. that he provided the gun. that he provided the gun. Like, literally admitted to it in a Like, literally admitted to it in a Like, literally admitted to it in a joint venture sense. Um you know, a joint venture sense. Um you know, a joint venture sense. Um you know, a defendant's own words or person's own defendant's own words or person's own defendant's own words or person's own words are admissible, especially we call words are admissible, especially we call words are admissible, especially we call it against interest. Cuz the idea is it against interest. Cuz the idea is it against interest. Cuz the idea is that this type of hearsay is reliable that this type of hearsay is reliable that this type of hearsay is reliable cuz who would admit to something like cuz who would admit to something like cuz who would admit to something like murder and not mean it and be lying? murder and not mean it and be lying? murder and not mean it and be lying? Um why would you make that up? So it Um why would you make that up? So it Um why would you make that up? So it certainly has to be corroborated in some certainly has to be corroborated in some certainly has to be corroborated in some way, but wow, and and I agree with you. way, but wow, and and I agree with you. way, but wow, and and I agree with you. This is so nostalgic for me. Um you This is so nostalgic for me. Um you This is so nostalgic for me. Um you know, certainly grew up East Coast, West know, certainly grew up East Coast, West know, certainly grew up East Coast, West Coast, um you know, diss track Coast, um you know, diss track Coast, um you know, diss track rivalries, um Tupac, Biggie, you know, rivalries, um Tupac, Biggie, you know, rivalries, um Tupac, Biggie, you know, implications and crossovers, Suge Knight implications and crossovers, Suge Knight implications and crossovers, Suge Knight kind of tied to both. Um and it just it kind of tied to both. Um and it just it kind of tied to both. Um and it just it it brings me back. It was such a huge it brings me back. It was such a huge it brings me back. It was such a huge part of of my growing up. The music and part of of my growing up. The music and part of of my growing up. The music and just without social media, that's how just without social media, that's how just without social media, that's how rivals talked write crap to each other. rivals talked write crap to each other. rivals talked write crap to each other. They made a rap song about it and they They made a rap song about it and they They made a rap song about it and they got it out to everybody and they're got it out to everybody and they're got it out to everybody and they're like, "Ha, look what I did to you." And like, "Ha, look what I did to you." And like, "Ha, look what I did to you." And then they do another one. then they do another one. then they do another one. Um so it's it's wild. Um Um so it's it's wild. Um Um so it's it's wild. Um certainly it can be admissible. There certainly it can be admissible. There certainly it can be admissible. There are obviously challenges here.

  20. are obviously challenges here. are obviously challenges here. Eyewitnesses may not be around 30 years Eyewitnesses may not be around 30 years Eyewitnesses may not be around 30 years later. If they didn't have them then, later. If they didn't have them then, later. If they didn't have them then, very unlikely they're going to have them very unlikely they're going to have them very unlikely they're going to have them now. Um other people in the car are now. Um other people in the car are now. Um other people in the car are already dead. So there were four people already dead. So there were four people already dead. So there were four people in that car and according to his own in that car and according to his own in that car and according to his own words, his memoir to his interview, he words, his memoir to his interview, he words, his memoir to his interview, he actually gave an interview um with actually gave an interview um with actually gave an interview um with regards to regards to regards to the assassination of Biggie, Biggie the assassination of Biggie, Biggie the assassination of Biggie, Biggie Smalls. Smalls. Smalls. And he's the only one that's still And he's the only one that's still And he's the only one that's still standing. And it's sort of like I'm sure standing. And it's sort of like I'm sure standing. And it's sort of like I'm sure the prosecution was sort of sitting the prosecution was sort of sitting the prosecution was sort of sitting there saying, "He's almost taunting us there saying, "He's almost taunting us there saying, "He's almost taunting us and inviting us to charge him. Why is he and inviting us to charge him. Why is he and inviting us to charge him. Why is he talking about this in such a brazen way? talking about this in such a brazen way? talking about this in such a brazen way? It It's a you know, it's a murder." It It's a you know, it's a murder." It It's a you know, it's a murder." Um and um you know, so I'll go back to Um and um you know, so I'll go back to Um and um you know, so I'll go back to you, um but it's you know, cold cases you, um but it's you know, cold cases you, um but it's you know, cold cases are very difficult for a lot of reasons are very difficult for a lot of reasons are very difficult for a lot of reasons and one of them is that even like the and one of them is that even like the and one of them is that even like the police, the investigators at the time police, the investigators at the time police, the investigators at the time maybe retired, moved on, or deceased. So maybe retired, moved on, or deceased. So maybe retired, moved on, or deceased. So you're losing you're losing you're losing who could have testified at the time to who could have testified at the time to who could have testified at the time to corroborate any of this. A lot of them corroborate any of this. A lot of them corroborate any of this. A lot of them are going to have moved on or be gone. are going to have moved on or be gone. are going to have moved on or be gone. >> Yeah. Yeah, you've got the combination >> Yeah. Yeah, you've got the combination >> Yeah. Yeah, you've got the combination of it being a cold case and then of it being a cold case and then of it being a cold case and then essentially a gang murder. So, you've essentially a gang murder. So, you've essentially a gang murder. So, you've got the the already the difficulties of got the the already the difficulties of got the the already the difficulties of a gang case where nobody wants to talk.

  21. a gang case where nobody wants to talk. a gang case where nobody wants to talk. Nobody wants to say anything. Nobody Nobody wants to say anything. Nobody Nobody wants to say anything. Nobody wants to admit to anything. Even if they wants to admit to anything. Even if they wants to admit to anything. Even if they are people who would like to see this are people who would like to see this are people who would like to see this man held responsible for the murder of man held responsible for the murder of man held responsible for the murder of their friend. One of those folks that their friend. One of those folks that their friend. One of those folks that they plan on calling, at least he's on they plan on calling, at least he's on they plan on calling, at least he's on the witness list, there's talk about him the witness list, there's talk about him the witness list, there's talk about him perhaps being put on the stand is Suge perhaps being put on the stand is Suge perhaps being put on the stand is Suge Knight. He was driving the car. He was Knight. He was driving the car. He was Knight. He was driving the car. He was sitting right next to Tupac when he got sitting right next to Tupac when he got sitting right next to Tupac when he got shot. He's already said he wants nothing shot. He's already said he wants nothing shot. He's already said he wants nothing to do with this whole thing. Do you, to do with this whole thing. Do you, to do with this whole thing. Do you, one, think he testifies and two, how do one, think he testifies and two, how do one, think he testifies and two, how do you think that goes if he's just going you think that goes if he's just going you think that goes if he's just going to be uncooperative? to be uncooperative? to be uncooperative? >> I think no way he testifies. I think he >> I think no way he testifies. I think he >> I think no way he testifies. I think he lawyers up and they find some way for lawyers up and they find some way for lawyers up and they find some way for him to take the fifth and get out of it. him to take the fifth and get out of it. him to take the fifth and get out of it. Now, of course, the prosecution can sort Now, of course, the prosecution can sort Now, of course, the prosecution can sort of throw a trump card in there and grant of throw a trump card in there and grant of throw a trump card in there and grant him immunity and then he can't take the him immunity and then he can't take the him immunity and then he can't take the fifth and not testify. And taking the fifth and not testify. And taking the fifth and not testify. And taking the fifth, by the way, doesn't mean that he fifth, by the way, doesn't mean that he fifth, by the way, doesn't mean that he was involved in the shooting directly, was involved in the shooting directly, was involved in the shooting directly, that he committed murder himself. It that he committed murder himself. It that he committed murder himself. It just means that in testifying, he would just means that in testifying, he would just means that in testifying, he would have to admit to something that could be have to admit to something that could be have to admit to something that could be construed as inculpatory or involved in construed as inculpatory or involved in construed as inculpatory or involved in a crime or the crime.

  22. a crime or the crime. a crime or the crime. Um you know, the rumor mill has been Um you know, the rumor mill has been Um you know, the rumor mill has been going on for 30 years. It's cooled off a going on for 30 years. It's cooled off a going on for 30 years. It's cooled off a little bit, but the the rumors back then little bit, but the the rumors back then little bit, but the the rumors back then was that he was directly involved. Um was that he was directly involved. Um was that he was directly involved. Um I'm sure he wants nothing to do with I'm sure he wants nothing to do with I'm sure he wants nothing to do with this. I'm sure he's thinking that Davis this. I'm sure he's thinking that Davis this. I'm sure he's thinking that Davis is not the brightest bulb to have is not the brightest bulb to have is not the brightest bulb to have written a memoir. written a memoir. written a memoir. Uh but you know, certainly the defense Uh but you know, certainly the defense Uh but you know, certainly the defense is going to say, "Come on, this is a is going to say, "Come on, this is a is going to say, "Come on, this is a book. So, I'm sure the defense is going to do So, I'm sure the defense is going to do So, I'm sure the defense is going to do that. And again, it's beyond a that. And again, it's beyond a that. And again, it's beyond a reasonable doubt, so even if people reasonable doubt, so even if people reasonable doubt, so even if people think that he could have been involved think that he could have been involved think that he could have been involved in it, that's not going to be enough. in it, that's not going to be enough. in it, that's not going to be enough.
